		<description><![CDATA[<FONT color=#ccff00 size=3>STATE OF THE INVESTIGATION,Eric Fryar, Avniel Adle<BR>« Thread Started Today at 9:39am » <BR>From Granny's board:<BR><BR>I received this letter.I have not signed a nda so here it is.<BR><BR><BR><BR>STATE OF THE INVESTIGATION<BR>Eric Fryar, Avniel Adler<BR><BR>When the Fryar Law Firm began investigating the existence of a CMKX trust fund there were a myriad of issues to address. Initially, there was the extensive administrative effort of setting up representation and communication of a shareholder group in excess of 200—sending out attorney engagement letters to over 200 clients, answering clients’ questions, and collecting the funds necessary to sustain the investigation. The firm created a website as a mainframe for client feedback and to organize our work product and evidence. Finally, the Firm reviewed company history, researched the legal and factual issues of the case and read and organized the litigation pleadings of the several lawsuits that CMKX has been a party to. All of these start-up costs were performed at a considerable discount to give our clients the best opportunity at a meaningful investigation into their claims.<BR><BR>The investigation has had a specific focus throughout, namely: how can we determine whether a CMKX trust fund exists at a minimal expense? The Firm created an Investigation Schedule in an attempt to set-forth what the shortest path to unequivocal evidence of a trust fund would be. Naturally, the course of our investigation has informed us what the next most cost-effective step should be and our investigation plan has evolved accordingly.<BR><BR>Over the past few months we have spoken to a number of players in the CMKX saga. We contacted Bill Frizzell repeatedly to see what connection there exists between CMKM’s efforts at securing assets stolen by corporate insiders (Casavant, Edwards, etc.) and a possible CMKX trust fund. Frizzell disclaimed any connection between the two and explained that the funds stolen by Casavant and co. were easily traceable and that has been the focus of CMKX’s litigation efforts. We asked Frizzell about whether the company has any evidence of naked short selling. Frizzell has guarded this information as extremely private and claims that the company is not allowed to release this information. In other words, to obtain this information we would have to litigate with the company (a simple inspection request will not do).  <BR><BR>In a similar vein, we have spoken to other attorneys that have favorably settled naked short selling cases. They too have confirmed that obtaining evidence of naked short selling from government entities is an uphill battle and likely a waste of time. Moreover, litigating against brokerage houses or other entities involved in the naked short selling of a company’s stock costs millions of dollars to finance. Thus, the Firm determined that litigating with Frizzell and CMKX would not be worthwhile at the moment or within the scope of our investigation. Likewise, sending Freedom of Information Acts to government entities would probably not yield any helpful information in the short term.<BR><BR>We have contacted a host of people who are allegedly connected to the missing trust account. Peter Maheu told us that he has no knowledge of any CMKX trust fund and that he would not return any more phone calls or letters. Keith Staub, the U.S. attorney who represented the SEC in the Bivens action said he had no knowledge whatsoever of any government trust, and in fact, that he was only put on the case to argue it out of court. Any real information would be in the SEC’s possession. Michael Phillips confirmed his story about seeing 3 CMKM trust accounts totaling trillions of dollars (more on him below). Lindell Bonney hung up on the Firm after we inquired what it means to be a “Paymaster”. Al Hodges never returned any of our letters or phone calls.<BR><BR>Following these efforts it occurred to us that deposing the parties who allegedly have personal knowledge of a CMKX trust fund would be the best plan of attack. Those parties are Al Hodges, Michael Phillips and Morris Richards. Consequently, we filed an extensive Rule 202 Petition seeking the depositions of Hodges, Phillips and Richards without filing a lawsuit.<BR><BR>One might wonder, what does it mean to depose a party without filing a lawsuit? That is an excellent question and one that required considerable legal research. Ordinarily, in order to issue subpoenas to compel testimony under oath and the production of documents requires the filing of a lawsuit. However, filing a lawsuit without an adequate factual basis can result dismissal without the opportunity to conduct discovery (this is what happened in the Hodges lawsuit), and more significantly can subject attorneys and their clients to monetary sanctions. Moreover, the persons who claim to have the information necessary for a lawsuit (Hodges, Phillips and Richards) would not be the target of the lawsuit, but only witnesses. Therefore, we are utilizing a little-known and little-used procedural tactic provided by Rule 202 of the Texas Rules of Civil Procedure. This is an innovative approach<BR>and is not guaranteed success, but we feel very optimistic that we have put together a compelling and valid legal position.<BR><BR>What we are doing is representing to a court in Texas that we wish to secure deposition testimony from 3 out-of-state witnesses for use in an anticipated lawsuit. Thus, no one is being sued here. We are telling a Judge that, in the interest of justice, the CMKX shareholders need to depose Hodges, Phillips and Richards, so that their testimony is preserved for use in an anticipated lawsuit. In essence, a lawsuit could not be filed until we have a responsible party to sue. We need to depose Hodges, Phillips and Richards to determine who we could sue to reclaim CMKX trust funds.<BR><BR>It is worth noting that a Rule 202 Petition is an extremely rare procedure. This is particularly true in light our request to depose out-of-state residents. The Petition seeks a deposition of Hodges in California and a deposition of Phillips and Richards in Florida. Thus, the Texas Court must issue what are termed “Letters Rogatory” to request courts in California and Florida to issue subpoenas to our witnesses.<BR><BR>Our petition is also a persuasive document. We must persuade a judge that our deposition of Hodges does not seek to discover privileged “attorney work product”. Rather, we are only interested in hard evidence of a CMKX trust fund within Hodges’ possession, custody or control. We may not discover material that Hodges prepared for use in the Bivens action, his mental impressions developed in anticipation of the Bivens action, or the communications between any of the parties to the Bivens action or their representatives, employees or agents.<BR><BR>The schedule of events is as follows: a hearing will be held on whether the petition will be granted (likely at the end of August or beginning of September). We will notify Hodges, Richards, and Phillips that the hearing will take place. If the judge grants our petition, Mr. Fryar and Mr. Adler will depose Hodges in California, and Richards and Phillips in Florida. We have requested that the witnesses produce documents at the deposition, e.g., a screen shot of the computer screen Phillips allegedly viewed, or a document verifying that Maheu met with the DTCC (in the case of Richards). These documents will be inspected and copied, and posted on the PBWorks website. The depositions will probably take place some time in October, depending on how long it takes to process the Letters Rogatory and set deposition dates in California and Florida. It will be necessary to retain the services of<BR>local attorneys in California and Florida to assist in the necessary filings in those states.<BR><BR>We would like to remind the shareholders the scope of our engagement. We have been retained to investigate the existence of a CMKX trust fund. We have not been retained to file a lawsuit. There is no magic bullet to remedy the wrongs perpetrated on the CMKX shareholders. Our best weapon is reliable evidence. If our investigation yields reliable evidence the shareholders will have something of value for use in an anticipated lawsuit. For now, the shareholders must understand that the Firm is doing our best to secure the information you have retained us to uncover. Additionally, any such lawsuit would also face hurdles of statutes of limitations, jurisdictional issues, and other potential obstacles. The best way to determine the viability of any such a litigation effort must start is valid evidence.<BR><BR>In closing, we would like to assure you that we believe we are breaking serious ground in this investigation and hope to have real answers for you shortly. We have no interest in fraternizing with any of the parties connected with the controversy. Our only goal is to get reliable information for the shareholders. We intend on securing depositions before suit, because we feel it is the fastest way to verify the existence of a CMKX trust fund at a minimal expense. Cottrell, B.A., M.S. As you are aware Mr. Cottrell and his wife are the beneficial owners of Pennsylvania Investments, Inc. and have requested that I communicate some urgent concerns regarding the subject U.S. Dollar Refunding Project. <BR><BR>I am advised and understand the following:<BR><BR><SPAN class=bigbull>•</SPAN> In 2007, funds aggregating 6.2 Trillion dollars were made available pro bono publico by and on Your Majesty’s behalf for the purpose of this Project. <BR><BR><SPAN class=bigbull>•</SPAN> The International Group of Seven (G-7) agreed to this refunding program at their meeting in Northern Germany in June, 2006 and reaffirmed their support in 2007.<BR><BR><SPAN class=bigbull>•</SPAN> These funds, to date, have not been deployed for the purpose for which they were intended.<BR><BR><SPAN class=bigbull>•</SPAN> Through the good offices of Christopher Edward Harle Story, FRSA, from the period September, 2008 through December 29, 2008, previous arrangements for conducting this program were revised and reorganized such that Mr. Michael C. Cottrell would be wholly in charge of the project.<BR><BR><SPAN class=bigbull>•</SPAN> Based upon advice received in 2009 Mr. Michael C. Cottrell is to be in charge of the refunding project pursuant to the information and proposal set forth in two notarized affidavits dated December 29, 2008 and March 3, 2009.<BR><BR><SPAN class=bigbull>•</SPAN> I am advised that Your Majesty has previously received and approved these terms and conditions.<BR><BR><SPAN class=bigbull>•</SPAN> Premised on this history, Mr. Cottrell, again through the good offices of Mr. Story, has established a firm in London to conduct the refunding operations denominated “Cottrell Securities Limited”. <BR><BR>This correspondence and request is premised upon the above facts.<BR><BR>Certain matters have come to the attention of Mr. Cottrell and myself which have caused considerable consternation as finalization of the refunding project has neared closure. I write to you on Mr. Cottrell’s behalf out of concern that certain of these activities may be taking place without your knowledge and in contravention of your desires, and in violation of agreements made on your behalf at the G-7 meetings in 2006, 2007 and 2008. <BR><BR>Mr. Cottrell has prepared an affidavit, which was duly notarized on March 31, 2010, which sets forth the initial events surrounding the ongoing attempts to bring this matter to conclusion; I will not repeat them here as a copy of such affidavit is included as an attachment. Since March 31, 2010 various actions which have been ongoing each and every day have suggested, at least initially, that successful conclusion was imminent. However, as of the date of dictating this correspondence (April 23, 2010) neither I nor Mr. Cottrell are confident that this matter will conclude as originally designed, promised and intended without intervention from your authority.<BR><BR>Let me hasten to apologize for the presumptive, perhaps arrogant, tone of this correspondence and submission to you. Cottrell, B.A., M.S., of Erie, Pennsylvania, USA, and his corporations: Pennsylvania Investments, Inc., registered in the Commonwealth of Pennsylvania, and Cottrell Securities Limited, registered in England and Wales.<BR><BR>I have been repeatedly advised by Lindell H. Bonney that the Basel List contains a Line Item providing for a loan for on-the-books trading purposes in the sum of $6.2 Trillion Dollars in the aggregate, for use to finance the long-since approved Dollar Refunding Program requested of the G-7 financial powers by her Majesty the Queen ‘for the sake of the whole of humanity’. <BR><BR>These sources have repeatedly confirmed to me, as Mr. Cottrell’s Attorney, that the Line Item funding is to be deployed for this purpose by Mr. Cottrell’s firm Pennsylvania Investments, Inc. <BR><BR>The matter has likewise been confirmed on several occasions directly to Mr. Cottrell, prior to my appointment as his Attorney.<BR><BR>The Dollar Refunding Program must ORIGINATE in the private sector, so that no corresponding PUBLIC DEBT is created on the other side of the balance sheet. Unfortunately, the US authorities have resisted this sound financing concept (the ONLY solution on the table) and seek to conduct the Dollar Refunding Program (on which the whole world depends) themselves, via the US Treasury, et. al., thereby generating a vast, open-ended further overhang of completely unnecessary official/public debt on the other side of the balance sheet. <BR><BR>Obviously, since the debt accumulated will be 100%, whereas any tax raised from such trades will not exceed, say, 35%, this severely exacerbates the US official debt overhang.<BR><BR>Such a course will therefore most certainly lead to US and global financial and economic disaster by rapidly accelerating the degradation of the US dollar and thereby inducing a Weimar-style hyperinflation.<BR><BR>On the well-known principle that ‘good money’ replaces ‘bad money’, and long since recognizing that the US authorities were unwilling to follow the sound path recommended by Her Majesty, Mr. Cottrell arranged for the formation of Cottrell Securities Limited, based in London, to handle the necessary fully taxable on-balance sheet trades.<BR><BR>A schematic plan (Figure 5A, Private Funding USD Refunding Loan) showing how the taxable trades will operate, is enclosed as the second sheet with the papers submitted herewith. The tax payable to the British authorities will be remitted along with any tax payable to the US authorities, directly to the British Treasury. I have prepared an update, which follows, that I am now prepared to have released to the various shareholder discussion forums, should one or more of you so desire. If you do decide to post this, please include the entire ‘Update.’<br><br><br><br>CMKX Litigation Update<br><br><br><br>This office represents seven of CMKX’s larger shareholders who collectively hold more than 3.5 Billion shares. We have prepared a Bivens based class action lawsuit seeking release of all the funds that have been collected for the benefit of CMKX shareholders, or for damages in an amount in excess of $3,780,000,000,000. This suit alleges that the SEC commissioners have violated the Fifth Amendment Constitutional property rights of the shareholders by withholding consent to the release of such funds, for years, which amounts to a taking without due process of law. Some of the specific allegations made in the complaint include:<br><br><br><br>From March 17, 2005 through April 29, 2005 CMKM traded publicly, in the US under the trading symbol “CMKX,” a total of 551,756,751,833 shares, an average share volume of more than 17 billion shares per day, reaching a maximum on April 21, 2005 of 94,654,588,201 shares. These figures do not include foreign trades nor trades made on an ex-clearing basis such as those disclosed by Jefferies &amp; Company , Inc. on May 6, 2005: between March 25, 2004 and September 21, 2004 Jefferies traded 111,780,681,204 shares of CMKX stock on an ex-clearing basis.<br><br><br><br>During the period of June 1, 2004 through October 28, 2005 a total of 2.25 Trillion “phantom” shares of CMKM Diamonds Inc, was sold into the public market through legitimate brokers, illegitimate brokers and dealers, market makers, hedge funds, ex-clearing transactions and private transactions. The sales of the majority of such shares were at all times known to the Securities and Exchange Commission, including Defendants herein.<br><br><br><br>At some date prior to June 1, 2004 the Securities and Exchange Commission in concert with the Department of Justice of the United States, together combined with Robert A. Maheu and others to utilize CMKM Diamonds, Inc. for the purpose of trapping a number of widely disbursed entities and persons who were believed to be engaged in naked short selling of CMKM Diamonds Inc. stock and cellar boxing the company. The Securities and Exchange Commission and the Department of Justice, with assistance from the Department of Homeland Security, believed and developed evidence that said short sellers were utilizing their activities to illegally launder moneys, wrongfully export moneys, avoid payment of taxes, and to support foreign terrorist operations. To fulfill the plan to criminally trap such wrongdoers, the Securities and Exchange Commission, with assistance from the Departments of Justice and Homeland Security:<br><br>&lt;!-- --&gt;a) Assisted in and approved the retention of Roger Glenn, an ex-SEC trial attorney and drafter of Sarbanes-Oxley, to join CMKM Diamonds Inc. for the purpose of verifying claims value, increasing authorized shares of stock to 800,000,000,000, and supervising from the inside of the company;<br><br>&lt;!-- --&gt;b) Encouraged the company to expand its promotional activities, assisted in the set up of the “racing activities” of the company, and underwrote a substantial portion of the cost of such activities;<br><br>&lt;!-- --&gt;c) Consented to, facilitated, and supported the sale of certain company claims to several foreign corporations;<br><br>&lt;!-- --&gt;d) Consented to, facilitated, and supported the conferences between Robert A. Maheu and his associate/assistant Royal Canadian Mounted Police Inspector William Majcher on the one hand, and the wrongdoing short sellers on the other, all for the purpose of settling the potential liability of said wrongdoers with consent of the U. S. Government and a representation of no criminal prosecution for such illegal sales;<br><br>&lt;!-- --&gt;e) Consented to, facilitated, and supported the declaration of dividends payable by the company to each common shareholder of CMKM Diamonds, Inc. <br><br>&lt;!-- --&gt;f) Consented to, facilitated, and supported the distribution of shares of CIM, a private company owned by Urban Casavant, as a stock dividend, including consent and approval of distribution of said shares to holders of more than 1.4 Trillion shares of CMKM Diamonds, Inc. common stock.<br><br>&lt;!-- --&gt;g) During the period from November, 2004 through April, 2005, CMKM Diamonds, Inc. negotiated the sale of some of its Saskatchewan, Canada mineral claims to three Chinese domiciled corporations with the advice and consent, inter alia, of the Securities and Exchange Commission. Proceeds from the consummation of such sales were placed into a frozen trust for disbursal at a later time. <br><br><br><br>During the period from March, 2004 through August, 2006, on behalf of CMKM Diamonds, Inc. Robert A.. Maheu, with assistance from Royal Canadian Mounted Police Inspector William Majcher, negotiated a settlement with the illegitimate brokers, dealers, market makers, hedge funds, and other persons and entities that had engaged in naked short selling of CMKM Diamonds Inc. stock and cellar boxing the company. In exchange for a U. S. Government promise of no prosecution for such sales, the wrongdoers each promised to pay negotiated amounts to a frozen trust for disbursal at a later time.<br><br><br><br>Plaintiffs herein are informed and believe, and based thereon allege, that other moneys have been collected for the benefit of the shareholders of CMKM Diamonds, Inc. from the Depository Trust &amp; Clearing Corporation, from the United States Government, and from the sale of additional assets including consent to enter into joint venture agreements with other companies holding mineral claims in Saskatchewan, Canada. Plaintiffs herein are further informed and believe, and based thereon allege, that said moneys, collected for the benefit of shareholders have also been placed in a trust or are otherwise now held in trust by the Depository Trust &amp; Clearing Corporation and the United States Treasury.<br><br><br><br>Plaintiffs herein are informed and believe, and based thereon allege, that at all times mentioned, the Securities and Exchange Commission reserved unto itself the sole and absolute discretion to determine when moneys collected pursuant to the scheme set forth above would and could be released for distribution.<br><br><br><br>Demand for release of said moneys has been repeatedly presented to the Securities and Exchange Commission without result. Agents and employees of the Securities and Exchange Commission and the Department of Justice have represented repeatedly that the release of moneys for distribution was imminent, and/or would occur within several weeks, and/or would occur within less than a month. Each of said representations have been made knowing them to be false, and at the specific direction of the named Defendants. These actions of withholding distribution of said moneys, without compensation and without due process of law, amount to a taking of the property of the individual Plaintiffs and of all similarly situated.<br><br><br><br>In an attempt to avoid protracted litigation we have seen to it that several attorneys at the SEC Office of General Counsel have a copy of the draft; we are further advised that the current SEC Commissioners are also aware   of the pending filing. Our expectation was   that the individually named Commissioners will not want to answer our lawsuit, thus leaving themselves open to the discovery process. The draft has been in SEC hands for approximately two weeks, and so far we have not received any response, meaningful or otherwise. They could well continue to stonewall, and force us to initiate the litigation. Maheu moved to Las Vegas from Los Angeles in 1966 when Hughes relocated to the top floor of the Desert Inn, which Hughes purchased when hotel management asked him to leave that year in time for New Year's Eve crowds.<BR><BR>“We weren’t gambling and we were tying up their best rooms — they were justified in trying to kick us out,” Maheu recalled in a 2004 interview with the Las Vegas Sun.<BR><BR>Maheu was born in Waterville, Maine, in 1918. After graduating from the College of the Holy Cross in Worcester, Mass., in 1950, he joined the Federal Bureau of Investigation. During World War II he posed as a German sympathizer.<BR><BR>In 1947, Maheu established his own investigative company. He also worked for the Central Intelligence Agency. He later admitted: "The CIA was my first steady client, giving me 'cut-out' assignments (those jobs in which the agency could not officially be involved)." This work brought him into contact with Howard Hughes, and in the late 1950s Maheu worked for him on a freelance basis. This included intimidating would-be blackmailers and obtaining information on business rivals.<BR><BR>Maheu began full-time work for Howard Hughes in 1966. He moved to Las Vegas, where he ran Hughes's casinos. Maheu explained later what his role was in the operation: "When he came here, he wanted to tie up all the property on the Strip to develop it properly. He didn't want it to be honky-tonk or like Coney Island. Hughes was a catalyst in the city cleaning up its act."<BR><BR>After losing his job with Howard Hughes in 1970, Maheu established a new company in Las Vegas called Robert A. Maheu and Associates. In 1993 Maheu published the book, "Next to Hughes," an autobiography written with Richard Hack.<BR><BR>In 13 years serving with Hughes, where he held the billionaire's power of attorney and spoke on Hughes' behalf for all public purposes, Maheu saw Hughes two times.<BR><BR>Maheu had battled cancer and heart problems. 		<description><![CDATA[<P>&nbsp; Well I don't see any news or <STRONG>PRs</STRONG> yet...I will wait one week then on <STRONG>Monday March 27th</STRONG> I will begin to organize the OMMM(Owners Million Millionaires Movement)...I will begin to draft an article that we can publish around the country...I have waited long enough for the news that never comes and the cert pull that never ends...anyone interested in joining can register at this site&nbsp;we can begin to organize another owners group dedicated to <STRONG>TRUTH</STRONG> and <STRONG>JUSTICE</STRONG>...our GOAL will be to bring our plight to the attention of every <STRONG>MAN,</STRONG> <STRONG>WOMAN,</STRONG> and <STRONG>CHILD</STRONG> in the <STRONG>US</STRONG> and in the <STRONG>WORLD</STRONG>...we will tell the story exactly as we have lived it without affixing blame or making assumptions...the WORLD can decide who is to be blamed and the WORLD will decide who to take action against...I have a lot of evidence myself and with other TRUE LONGS help I think we can make a good case for the INJUSTICE visited upon us...we can get a pool of $$$ that will <STRONG>ONLY</STRONG> go to taking out AdS in any newspapers.magazines, and other forms of MEDIA...we can contact TV shows and networks where we can try to tell our story...as a member of the <STRONG>OG </STRONG>I will try to get the <STRONG>TF</STRONG> records and the OG records even though I have kept an audit of the numbers...we can see if they match the subpoenaed records...if we get news and are satisfied with the results before then I will call off the movement but <STRONG>I&nbsp;WILL NOT FADE AWAY</STRONG>...we have been through too much to let this die a quiet death IMO...good luck to everyone in the mean time...we&nbsp;could call for a <STRONG>NATIONAL DAY OF BOYCOTT OF TRADING</STRONG>...a wakeup call for money people...<STRONG>WE ARE YOUR MEAL TICKET...WITHOUT US YOU ARE NOTHING...REMEMBER THAT HOGS</STRONG>...Flying Moose(cmkx-treme)</P>]]></description>
